法定许可，即任何人可以事先不经知识产权权利人的许可，在特定的条件下，以某种特定的方式使用某项知识产权，但是事后要向该项知识产权权利人支付许可使用费；（3）强制许可，
国家主管知识产权的
行政机构，在不经某项知识产权权利人同意的情况下，依照法定条件和法定程序，批准特定人在特定的条件下，以某种特定的方式使用某项知识产权，一般对于强制许可是要严加限制的，仅适用个别类型的知识产权（如
